1. PURPOSE
These general conditions define the rights and obligations of the parties in the context of the reservation of stays and services offered by the Terre & Mer estate, established at 15 rue de la ville es Rouxel in Binic-Etables-sur-Mer. They govern all the steps necessary for the reservation and monitoring of the reservation between the contracting parties. The customer acknowledges having read and accepted these general conditions of sale and the conditions of sale of the rate offered on our reservation platform. These general conditions of sale apply to all reservations concluded.

2. RESERVATION
The customer chooses the services presented on our website, brochure or booking platform. He acknowledges having taken note of the nature, destination and booking terms of the available services and having requested and obtained the necessary and/or additional information to make his booking with full knowledge of the facts. The customer is solely responsible for his choice of services and their suitability for his needs, such that our liability cannot be sought in this regard. The booking is deemed to have been accepted by the customer at the end of the booking process.

3. REGULATIONS
A 30% deposit will be required upon booking for any stay starting more than 30 days after this date (or 45 days for a privatization of the estate). The balance must be received (check, transfer or credit card) 30 days before arrival (or 45 days for a privatization of the estate). Upon receipt of the deposit payment, you will receive a confirmation email containing practical information about your stay.

5. CAPACITY
The number of people mentioned in our prices corresponds to the maximum occupancy allowed taking into account the available equipment. It cannot be exceeded for safety and insurance reasons. The rental of accommodation implies the total acceptance of the conditions of sale by the contracting parties.

6. LOCATIONS
Rental periods and duration: Rentals are possible for a minimum of 2 nights outside high and very high season where accommodation is rented by the week only.
Rentals are available from 3pm on the day of arrival and until 8pm. They must be vacated before 10am on the day of departure (or 1pm for a privatization of the domain) . Late check-out is available as an option depending on availability. Any excess will result in the invoicing of an additional day. All rentals are nominative and cannot be transferred or sublet under any circumstances.
Security deposit: Tenants must provide their credit card imprint upon arrival if they have paid for the stay with another means of payment. The latter will only be debited if there is damage to the equipment or for additional services ordered during your stay at the Terre & Mer estate and not paid for. It will be collected via the credit card imprint:

• The value of missing or broken items;
• A flat rate of €50 for uncleaned accommodation (not returned in a perfectly clean state);
• The amount of repairs in the event of damage caused by the occupant.

Any damage, missing items or unpaid debts will be the responsibility of the customer after debiting the credit card.
The rates are inclusive of all taxes with a VAT rate of 10% applicable on the day they were determined. Any subsequent change in the applicable VAT rate, occurring between the time the rates were determined and the invoicing of the stay, will result in a corresponding change in the price inclusive of all taxes, which the customer accepts without reservation.
Minors must be accompanied by their parents or legal guardians.
Special request: Terre & Mer cannot guarantee any special request made when booking. The accommodation number will be communicated upon arrival.
The plans and photos presented in the brochure and on our websites are not contractual. The Terre & Mer domain reserves the right to update and supplement them at any time.

7. RULES OF STAY
The reservation of the stay only becomes effective after confirmation by our services and payment by the tenant of the deposit.
In the case of payment by bank card, the payment card may be refused for several reasons: Stolen card, blocked card, limit reached, data entry error... In the event of a problem, the customer must contact their bank on the one hand, and the establishment on the other hand, to confirm their reservation and payment method. Tourist taxes must be paid directly on site to the establishment.
All reservations, regardless of their origin, are payable in euros. If the debit at the establishment is made in a currency other than that confirmed on the reservation, the exchange fees are the responsibility of the customer.

8. MODIFICATION OF STAY
Possibility of modification subject to availability. Any modification incurs an additional processing fee of €10. For a privatization of the glamping, only the conditions of the contract apply.

9. LATE ARRIVALS / EARLY DEPARTURES
In the event of a no-show by the customer on the day of arrival before 8 p.m. and in the absence of a written message from the customer, specifying that he had to postpone or delay the date of his arrival, the accommodation becomes available at 3 p.m. the day after the arrival date specified in the rental contract, and full payment of the services remains required. No reduction will be granted in the event of late arrival or early departure.

10. PROMOTIONS – LAST MINUTE SALES
On these occasions, it is possible that for the same stay, customers have paid different prices. Customers who have paid the highest price will not be able to benefit from a refund representing the difference in price they paid and the promotional price. Discounts are not cumulative with promotions under any circumstances. The price confirmed to the customer remains a non-revisable price.

11. CANCELLATIONS
Cancellation of stay by the Terre & Mer estate before your arrival:In case of force majeure, the management reserves the right to cancel your stay for security reasons. If you have already left your home, we will offer to relocate you to other similar accommodation at no extra charge.
If none of these offers satisfy you, the full amount paid will be refunded to you; no other compensation may be claimed.
Cancellation of stay by yourself before your arrival: the customer must notify the glamping in writing (tracked mail, email with request for acknowledgment of receipt). Failing this, the customer will be required to pay the full amount due under the contract. Domaine Terre & Mer reminds you that according to article L.121-20-4-2° of the Consumer Code, the right of withdrawal is not applicable to accommodation, catering and leisure services provided on a date according to a specific frequency. Domaine Terre & Mer informs the customer that he has the possibility of taking out cancellation insurance in the event of illness, force majeure, accident, death or other. Domaine Terre & Mer cannot be held responsible for any costs related to any cancellation in any of the above cases. Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the customer will result in the cancellation of the reservation at the customer's expense, without prejudice to any civil or criminal action against the latter.
FOR ANY STAY CANCELLED before the arrival date, and not falling within the cancellation clauses mentioned above, we will retain:

• More than 30 days before arrival: 30% of the amount of the stay (45 days for privatization of the estate);
• Less than 30 days before arrival as well as for any interrupted or unused stay, for whatever reason, the entire amount of the reserved stay will be payable or will remain acquired by the Terre & Mer estate. This period is 45 days for a privatization of the estate.

12. ANIMALS
NO ANIMALS ARE ALLOWED IN OUR ESTABLISHMENT.

13. VALUABLES
The Terre & Mer estate cannot be held responsible for thefts committed in your accommodation, in your car or within the grounds of the estate. Valuables must remain under the customer's supervision.

14. CLAIMS
Any complaint relating to a stay must be sent, under penalty of foreclosure, by registered letter with acknowledgment of receipt within 8 days following the stay.

15. INTERNAL RULES
All customers are required to comply with the internal regulations of the domain, failing which they will be subject to sanctions up to and including termination of the contract.
Any behavior contrary to good morals and public order will lead the establishment to ask the customer to leave the property without any compensation and/or without any reimbursement.
You are deemed to have read and accepted these elements of the internal regulations and to respect them during your stay.
It is strictly forbidden to light a fire on the estate, except under constant supervision in the authorized barbecue area.
During your stay, we ask that you respect all markings and safety instructions as they will be displayed to you, and that you return the keys to your rental.
As glamping is based on calm and relaxation, we ask our guests to avoid any noise pollution after 10 p.m.
On the day of your departure, rentals must be vacated before 10am (except for optional late departure). You are asked to leave the place in a perfect state of cleanliness. Otherwise, a flat rate of €50 will be charged. Any damage will be charged at the price of repair or replacement.
Electric barbecues are prohibited. Charcoal barbecues are permitted provided that they are not under a roof or in a location that could damage or harm the installations and vegetation.

16. IMAGE RIGHTS
You expressly authorize, and without compensation, the establishment to use, on any communication medium, the photos of you or your children that could be taken during your stay, for the advertising needs of the glamping, unless you expressly inform the management of your wish to the contrary. The reuse of photos and other visuals of the Terre & Mer estate is prohibited without written authorization from the management.

17. EVIDENCE AGREEMENT
The entry of the required banking information, as well as the acceptance of these general conditions and the voucher or the reservation request, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature. The computerized records kept in the computer systems of elloha.com. will be kept under reasonable security conditions and considered as proof of communications, orders and payments between the parties. The customer is informed that his IP address is recorded at the time of booking. Constellation SAS, in its capacity as a professional, has undertaken to the establishment to take all security measures and respect data confidentiality.

18. FORCE MAJEURE
Force majeure means any event external to the parties that is both unforeseeable and insurmountable and prevents either the customer or the establishment from fulfilling all or part of the obligations set out in the contract. Cases of force majeure or fortuitous events are considered to be those usually recognized by the case law of the French Courts and Tribunals. Each party may not be held liable to the other party in the event of non-performance of its obligations resulting from a force majeure event. It is expressly agreed that force majeure suspends, for the parties, the performance of their reciprocal obligations and that each party shall bear the cost of the resulting costs.

19. DISPUTE RESOLUTION
These General Terms and Conditions of Sale are governed by the law of the country of establishment without prejudice to any mandatory protective provisions that may be applicable in the country of residence of consumers. Disputes are settled solely by the Commercial Court of Saint-Brieuc.

20. VALIDITY OF THE GENERAL CONDITIONS
These general terms and conditions of sale may be modified and/or supplemented by the establishment at any time. In this case, the new version of the general terms and conditions of sale will be put online by the Terre & Mer domain. As soon as it is put online on the internet, the new version of the general terms and conditions of sale will automatically apply to all customers.
